Both the defendant and the Village of Hales Corners have the right to appeal the decision of the Court. If you are found guilty and you decide to appeal the decision of the Judge, you must:
- File a written Notice of Appeal with the Court Clerk.
- The written notice of appeal MUST be given to the Court Clerk within 20 days of the Judgment (Saturdays and Sundays are included).
- When filing the Notice of Appeal, you must also pay the forfeiture imposed (check should be made payable to Village of Hales Corners) plus the appeal fee (separate check made payable to Clerk of Circuit Court).
- Failure to pay said forfeiture and appeal fees will result in your appeal not being processed.
An appeal will result in a trial "De Novo" (an entirely new trial) in Circuit Court. The "De Novo" trial will be conducted by a Circuit Court Judge. Currently the cost is $138.50.
You may request a jury trial in the Notice of Appeal. A jury trial consists of a 6 person jury. Currently the cost for a six-person jury is $36.00.
Total for both a trial “De Novo” and a six-person jury is $174.50
